Because Hastings is a mere five blocks from the headquarters of Twitter, one of the better known new economy companies, the working title of the program is “Old Risks Meet the New Economy: Insurance Issues for the 21st Century.”

While the program outline is quite tentative, we anticipate programs on the following general subjects:

  • D&O Coverage, with a particular emphasis on issues likely to arise with emerging and new economy companies.
  • The Yates Memo and its impact on both policyholders and insurers.
  • Cyber liability coverage issues.
  • Coverage issues related to the sharing economy.
  • Two to three panels which would qualify for ethics credit, one on mediations, one on the duties and obligations of independent counsel, and one on the reporting duties of counsel defending the policyholder.
  • A bad faith topic, ideally involving something which also implicates how the policyholder and its counsel engage with the insurer.

The program is not limited to these topics and if you believe there is another topic which is better suited for the program, our members and those from the legal and law school communities who may be in attendance, please suggest it. Panels must be evenly balanced between policyholder and carrier attorneys. Some panels may also include a judge, regulator, or faculty member from UC-Hastings.
